Terms & Conditions – Coen Blankwaard Photography

These Terms & Conditions apply to all services and agreements of Coen Blankwaard Photography, a trade name of Blankwaart idee & vorm B.V., based in Eindhoven, The Netherlands.

1. Applicability

These Terms & Conditions apply to all offers, agreements and services provided by Coen Blankwaard Photography.

By booking a service, you agree to these Terms & Conditions.

2. Quotes and bookings

  • Quotes are non-binding and valid for 14 days unless stated otherwise
  • An agreement is confirmed once accepted in writing (e.g. via email)
  • I reserve the right to refuse any assignment

3. Pricing and payment

  • All prices are excluding VAT unless stated otherwise
  • Invoices must be paid within 14 days
  • Late payments may be subject to statutory interest and collection costs

4. Cancellation and rescheduling

  • Cancellation by the client:
    • Up to 14 days before the shoot: free of charge
    • Within 14 days: 50% of the agreed fee
    • Within 48 hours: 100% of the agreed fee
  • Rescheduling is possible in consultation and subject to availability

5. Execution of services

  • I will perform the assignment to the best of my ability
  • I retain full creative control over the shoot and editing
  • Specific requests must be discussed in advance

6. Delivery

  • Delivery times are indicative unless agreed otherwise
  • Images are delivered digitally unless otherwise agreed
  • Selection and editing are at my discretion

7. Liability

  • I am not liable for indirect or consequential damages
  • Liability is limited to the amount of the invoice
  • I am not responsible for loss of files due to circumstances beyond my control

8. Force majeure

In case of force majeure (e.g. illness, weather conditions, equipment failure or other unforeseen circumstances), I reserve the right to reschedule the shoot or provide a replacement photographer.

9. Copyright and usage

  • All images remain the intellectual property of Coen Blankwaard Photography
  • The client receives a non-exclusive, non-transferable usage license unless otherwise agreed
  • Images may not be altered, resold or used commercially without prior written permission
  • Credit is appreciated where reasonably possible

10. Portfolio and promotional use

The photographer reserves the right to use images for portfolio, website, social media and promotional purposes.

If the client does not wish for images to be used, this must be communicated in writing prior to the shoot. The photographer will respect reasonable requests regarding privacy.

11. Complaints

Complaints must be submitted in writing within 7 days after delivery. I will make reasonable efforts to resolve the issue.

12. Governing law

All agreements are governed by Dutch law.

Any disputes shall be submitted to the competent court in the Netherlands.

13. Amendments

I reserve the right to update or amend these Terms & Conditions at any time. The most current version will always be available on the website.
